1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Goimu Fitness (“we,” “us,” or “our”), concerning your access to and use of the www.goimufitness.com website as well as any related applications (the “Site”).
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, logos, and the fitness equipment designs and specifications (collectively, the “Content”) are owned or controlled by us or licensed to us, and are protected by copyright, trademark, and other intellectual property laws.
The Goimu Fitness name and logo, and all related product names are our trademarks. You may not use them without our prior written permission.

3. User Representations & Acceptable Use

By using the Site, you represent and warrant that you are at least the age of majority in your jurisdiction. You agree not to use the Site:

  • For any unlawful purpose or to solicit others to perform unlawful acts.

  • To infringe upon or violate our intellectual property rights or the rights of others.

  • To submit false or misleading information.

  • To upload or transmit viruses or any other malicious code.

  • To collect or track the personal information of others.

  • For any obscene or immoral purpose.

  • To interfere with or circumvent the security features of the Site.

4. Product Information & Purchases

  • Accuracy: We strive to display accurate product colors, images, specifications, weights, and dimensions. However, we cannot guarantee your screen’s accuracy. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

  • Pricing: All prices are in US Dollars (USD) unless otherwise stated. We reserve the right to change prices at any time. Sales and promotions are subject to specific terms stated at the time of offer.

  • Orders: Your order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities, inaccuracies in product information, or suspected fraud. We may require additional verification before shipping.

  • Fitness Equipment Use: You acknowledge that fitness equipment can be dangerous if used improperly. You are solely responsible for ensuring your workout area is safe, for properly assembling all equipment according to the provided instructions, and for using the equipment within its stated weight capacities and for its intended purpose. We are not liable for any injury, damage, or loss resulting from improper assembly, use, or maintenance.

5. Shipping, Delivery & International Orders

  • Shipping estimates are provided at checkout and are not guaranteed. Delivery times may vary.

  • International Orders: You are responsible for any and all customs duties, import taxes, and brokerage fees levied by your country. We cannot predict or control these charges. Please contact your local customs office for information.

  • Risk of Loss: Title to, and risk of loss for, all products passes to you upon our delivery to the carrier.

6. Disclaimer of Warranties & Limitation of Liability

  • THE SITE AND PRODUCTS ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. YOU USE THE SITE AND PRODUCTS AT YOUR SOLE RISK. EXCEPT AS EXPRESSLY PROVIDED IN OUR WARRANTY POLICY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GOIMU FITNESS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS.

  • Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to us in the six (6) months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Goimu Fitness and our affiliates from and against any and all claims, liabilities, damages, losses, and expenses arising out of or relating to your violation of these Terms or your use of the Site or products, including, but not limited to, injuries sustained during equipment use.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved through final and binding arbitration in San Francisco County, California, subject to the rules of the American Arbitration Association.

9. Changes to Terms

We reserve the right to make changes to these Terms at any time. The updated version will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
